This Privacy Policy sets out our policies regarding the collection, use and protection of the personal data (also known as personal information) of those using www.vinumversa.com or contacting us by telephone or in writing. Personal Data means any information that can identify a specific individual, such as name and address, telephone number, e-mail address or credit card number.

VinumVersa Limited, the owner of vinumversa.com, is a data controller in respect of the personal data we collect about you for purposes of the EU General Data Protection Regulation (EU Regulation 2016/679) ("GDPR") and the UK Data Protection Act 2018 and any other data protection legislation which supplements the GDPR in the United Kingdom in the future.

In this document, we explain what information we’re likely to hold, how we collect it and how we will use or share it. It also explains your rights and how to contact us or the ICO in the event you have a complaint. Our commitment to you is that we will continue to treat your personal data fairly and legally and with the same discretion and respect as we have always applied.

  1. When browsing our site, you are not required to provide any personal information until you choose to register as a user or sign up for one of the www.vinumversa.com (“us”/”our”/”we”) e-mail newsletters or other services as described below.

  2. We will keep information that you give us (“Personal Information”) as follows:

    1. If you wish to receive our newsletter, you must give us your email address (“E-mail Details”). 

    2. If you register with us as a user:

      1. You must provide us with certain personal information such as your name, your billing address, your preferred telephone number and your e-mail address (“Registration Details”). Registration will not be possible without these Details and may be terminated without notice if  these Details are removed and not replaced.

      2. You may provide us with (at your option) details of:

        1. payment methods including but not exclusively (credit card, debit card, Mangopay) (“Payment Details”);

        2. your nominated bonded storage warehouse and account number (“Storage Details”);

        3. details of any other person that you wish us to communicate with or arrange delivery to, or collection from (“Third Party Details”). If you give us Third Party Details you will be deemed for the purposes of this Agreement to have obtained the Third Party’s consent to give us their details;

        4. if you are a non UK resident, we may require passport details (“Passport Details”) in order to comply with and carry out due diligence in regard to EU and International money laundering laws particularly for large transactions that may pass through the site. These details are held by us securely via a third-party provider in case of security checks by UK or EU authorities. 

    3. To the extent that our services are provided and used by you, we will use the information you give us to facilitate the service requested. For example, if you email us with a question, we will use your email address, name, nature of the question, etc. (“Other Details”) to respond to your question. We may also store such information to assist us in making the site the better and easier to use.

  3. Your Email Details, Registration Details, Payment Details, Storage Details, Third Party Details, Passport Details and Other Details are together in the category of “Personal Information” and references to “Personal information” in this Agreement shall refer to one or more of those sets of details as the context so admits.

  4. We will process your Personal Information for (i) personal identification; (ii) to allow us to contact you for customer service purposes, if necessary; (iii) to customise the content of our site to meet your specific needs; (iv) to make product improvements to our site (v) confirm transactions or other dealings with you and (vi) to send you (if you do not opt out) updates from us about new wine listings, special offers, new company services, and other noteworthy items. However, you may choose at any time to no longer receive these types of e-mail messages. 

  1. In addition to our processing of your Personal Information as above:

    1. We use Mangopay’s services. Should you choose this method of payment, to bill you for goods and services, you will be required to disclose your name, billing address and credit card information to Mangopay. By choosing to use Mangopay as a method of payment you are accepting their terms of agreement and supplying the relevant information required.   2. You can opt out of receiving emails from us by clicking on the “unsubscribe” link and following the instructions or by emailing info@vinumversa.com.

  1. Where you unsubscribe from our marketing communications, we may keep a record of your email address to ensure we do not send you marketing emails in future.

  1. In addition to the circumstances described above, we may disclose Personal Information to a third party if required to do so by law, court order, as requested by other government or law enforcement authority, or in the good faith belief that disclosure is otherwise necessary or advisable including, without limitation, to protect our rights or properties or when we have reason to believe that disclosing the information is necessary to identify, contact or bring legal action against someone who may be causing interference with our rights or properties, whether intentionally or otherwise, or when anyone else could be harmed by such activities.

  2. In addition to collecting the Personal Information you give us, we automatically log generic information about your computer’s connection to the Internet (“Session Data”) that is, subject to Clause 11, anonymous and not linked to any personal information. Session Data includes IP address, operating system, browser used, pages viewed, activities conducted by the visitor to www.vinumversa.com. We use Session Data to analyse usage of www.vinumversa.com, to maintain and improve the administration of our systems, and to diagnose and remedy any technical problems with our servers and let us better administer our systems. 

  3. Although Session Data does not identify any visitor personally, it is possible to determine from an IP address a visitor’s Internet Service Provider (ISP) and the approximate geographic location of his or her point of connectivity.

  4. Session Data may be collected through the use of Cookies. We also use Cookies to keep track of what you have purchased and to deliver content specific to your interests and to save your password (if you have supplied us with one). Cookies are small pieces of information that are stored by your browser on your computer’s hard drive that are read only by the server that placed them. Our Cookies do not collect, store or pass on Personal information. We reserve the right to restrict a user’s use of www.vinumversa.com if that user does not permit us to use Cookies when asked.   5. VinumVersa Ltd is the data controller of your information. This means that we exercise some judgment in determining how and why to process the information you share with us. We may share your information with the other members of our group of companies. If you have questions about how we process your information that aren’t answered in this policy, we invite you to get in touch with us at info@vinumversa.com.  

  1. Personal Information you share with us is stored and hosted in the European Economic Area (EEA). 

  2. We will retain your Personal Information for the period necessary to fulfil the purposes outlined in this Privacy Notice unless a longer retention period is required or permitted by law. After this period, it will be deleted or in some cases anonymised. 

  3. Our retention of your Personal information is subject to the following further provisions:

    1. where you have made a purchase with us, we will keep a record of your purchase for the period necessary for invoicing, tax and warranty purposes. Whilst you are an active customer (which means you have purchased from us) we will hold on to your information for as long as needed to give you the best possible customer service; financial information we will hold for 6 years. We may also keep a record of correspondence with you (for example, if you have made a complaint) for as long as is necessary to protect us from a legal claim.

    2. Where we have collected the Personal Information based on your consent and we have no other lawful basis to continue with that processing, if you subsequently withdraw your consent then we will delete your Personal Information.

    3. In certain circumstances we may retain your personal data where such retention is necessary for compliance with a legal obligation to which we are subject, to resolve disputes and enforce our agreements.

    4. To the extent that the legal basis for our processing of your Personal Information is consent, you have the right to withdraw that consent at any time.

In the event that you wish to make a complaint about how we process your personal information, please contact us in the first instance at info@vinumversa.com  and we will endeavour to resolve your query as soon as possible. If you consider that our processing of your personal information infringes data protection laws, you have a legal right to complain to a supervisory authority which in the UK is the Information Commissioner’s Office.
